Rental Period

The conditions of this agreement apply to any vehicles, including replacement vehicles rented from Glo.

Renter will rent the vehicle for the rental period shown in this Agreement. Glo may agree to extend this rental period but not normally exceed 30 days

If Renter does not bring the vehicle back on time he is breaking the conditions on this Agreement. Glo can charge render for every day or part day Renter has the vehicle after he should have returned it to Glo. Glo will charge Renter at the contracted rate until it gets the vehicle back

Renter’s Responsibilities

  1. Renter must look after the vehicle. Renter must always look after the vehicle when he is not using it, and he will incur a charge (which Glo will set from time to time) for lost keys. Renter must use any security device fitted to or supplied with the vehicle. Renter must make sure that he uses the correct fuel
  2. Renter is responsible for any damage to the roof or upper part of the vehicle caused by hitting low-level objects, such as bridges or branches. This applies irrespective of whether or not Renter has opted for collision damage waiver in accordance with Clause 7.
  3. Renter must not sell, rent, or dispose of the vehicle or any of its parts. Renter must not give anyone any legal rights over the vehicle.
  4. Renter must not let anyone work on the vehicle without Glo written permission.
  5. Renter must let Glo know as soon as he becomes aware of a defect in the vehicle.
  6. Where Glo has agreed to deliver the vehicle to Renter, Renter’s liability for damage and theft shall begin on delivery of the vehicle. Renter must bring the vehicle back to the agreed return location during the opening hours displayed at the rental location. One of Glo’ staff must see the vehicle to check that it is in good condition. Where Glo has agreed that Renter may return the vehicle outside business hours, or where Renter has requested collection of the vehicle, Renter’s liability for damage and theft shall extend to the earlier of midday of the first working day following the requested collection time (working day is defined as Monday to Friday 8 am to 6 pm), or the time of re-inspection of the vehicle by a member of staff.
  7. Renter will have to pay for repairs if the vehicle needs more than Glo’ standard valeting (cleaning), or if the vehicle has been damaged either inside or outside (whether or not it is the Renter’s fault).
  8. Renter must check before bringing back the vehicle that he has not left any belongings in the vehicle.

Glo Responsibilities

Glo has maintained the vehicle to at least the manufacturer’s recommended standard. Glo undertakes that the vehicle is roadworthy and suitable for renting at the start of the rental period. Glo will identify and agree on any existing damage with the Renter on the Rental Vehicle Condition Report.

Property

Glo is only responsible for loss or damage to property left in the vehicle if the loss or damage results from Glo’ negligence

Conditions for using the vehicle

The vehicle must only be driven by the person(s) named overleaf or by anyone Glo authorizes in writing. Anyone driving the vehicle must have held a full current driving license for at least one year.

Charges

Rental will pay the following charges:

  1. The rental charge, any applicable city supplement, the standard daily contribution to the road fund license, and other optional charges at the rates shown overleaf.
  2. Any charge for loss or damage resulting from non-compliance with Clause 2.
  3. A refueling service charge if Renter has used, and not replaced, more fuel than Glo supplied originally (unless at the time of signature of this Agreement a sum has been entered overleaf, in which event Renter has opted to pay that sum for a full tank of fuel, it being understood that no credit will be granted for any unused fuel at the termination of the rental). The refueling charge is at the rates published at the rental location.
  4. On demand, all fines and court costs for parking, traffic, or other offenses (including any costs which arise if the vehicle is clamped). Renter must pay the appropriate authority any fines and costs. If Renter does not, Renter will be responsible to pay Glo’ reasonable administration charges which arise when Glo deals with these matters.
  5. On demand, the full cost of repairing or replacing the vehicle if it is damaged or stolen (even if it is not Renter’s fault). Renter may not have to pay the whole of the cost of repairing or replacing the vehicle if Renter has accepted Glo’ risk protection program as shown overleaf (subject to Clause 7 below).
  6. On demand, a loss of income charge. Glo will charge Renter at the contracted rate if it cannot rent out the vehicle because it needs to be repaired or is a write-off and Glo is waiting to receive full payment of the vehicle’s value. Glo will do everything it can to make sure the vehicle is repaired or gets payment as soon as possible. Glo will never charge Renter for more than 30 days’ loss of income. Renter shall also be liable to charge for any diminution in value of the vehicle on resale as a result of damage to the vehicle during the rental period.
  7. On demand, any charges made by Customers and Excise, or any other authority, as a result of the seizure of the vehicle by them, together with a loss of income charge, as provided under (f) above, whilst the vehicle is unavailable for rental.
  8. Any published rates for delivering and collecting the vehicle.
  9. Value added tax and all other taxes and levels on any of the charges listed above, as appropriate.

Renter is responsible for all charges, even if he has asked someone else to be responsible for them.

If it is Renter’s intention to pay by credit card or charge card, then Renter’s signature overleaf shall constitute authority for Glo to compute and debit the final total charges against Renter’s account with its specified card issuing organization, including charges due as a result of theft of or damage to the vehicle and any fines and court cost for parking and traffic offences as described in Clause 6(d).

Where Renter elects that any charges under this Agreement are billed in a currency other than Rupiah (or payment is tendered in another currency), the rate of exchange used for any currency conversion shall be determined by Glo in accordance with its standard practice, including Glo’ standard handling charge.

Risk Protection

The rental charges under this Agreement include motor third-party insurance up to Rp. 5,000,000 (five million Rupiah).

Glo will provide collision damage waiver and theft protection if Renter has indicated his acceptance by ticking the appropriate boxes overleaf. If Renter accepts these, he still has to pay the excesses as shown overleaf every time the vehicle is damaged or stolen (even if it is not the Renter’s fault). The benefit of collision damage waiver may not apply in circumstances where Renter has used the vehicle in an abusive manner.

Renter can get details of Glo’ risk protection program (including the main exclusions) from the office he rented the vehicle from.

Renter’s own insurance

Renter may, with Glo’ prior written agreement, arrange his own insurance by ticking the appropriate box overleaf for a full duration of the rental and is then liable for the full cost of repairing or replacing the vehicle if it is damaged or stolen (even if it is not Renter’s fault). Glo has to agree to the amount of coverage Renter arranges, the type of policy, and the insurer Renter has chosen. Glo may ask Renter’s insurers to record Glo’ name as owners of the vehicle and loss payee.

If the vehicle is damaged or stolen, Renter will let Glo negotiate with the insurer about whether the vehicle can be repaired or what compensation is due to Glo. Renter is financially responsible for settling any costs if the policy Renter has arranged fails and the vehicle is damaged, lost, or stolen, or if claims are made by any other party.

What to do in case of accident or theft

If Renter has an accident, he must not admit responsibility. He should get the name and address of everyone involved, including witnesses.

Renter should also:

  • Make the vehicle secure
  • Tell the police immediately if anyone is injured or there is a disagreement as to fact
  • Call Glo’ nearest office straight away

Renter must then fill in Glo’ incident report form (which must also be filled in if the vehicle is stolen) and send it to the address overleaf within 24 hours. Renter shall remain liable irrespective of whether he has completed this form.

Information

Glo will maintain the personal information on the form overleaf as part of Glo’ records to assist it to maintain and improve its administration and management of its car rental business.

Renter is welcome to see the information held about him at any time and to make any necessary amendments to keep the information up to date.

In order further to enhance its car rental services and promote Renter’s custom for other Glo group companies, Glo may also add details and Renter’s name and address to Glo’ marketing database so that Glo may from time to time notify Renter of new services and other offers of the Glo group. Glo may share this information with its group companies and business partners, and Glo may from time to time notify Renter of the services and offers of the Glo group companies and business partners.

Ending the Agreement

  1. If Renter is a consumer, Glo will end this Agreement straight away if it finds out that Renter’s goods have been taken away from him to pay off his debits, or a receiving order is made against him. Glo will also end this Agreement if Renter does not meet any of the conditions of this Agreement.
  2. If Renter is a company, Glo will end this Agreement straight away if:
    • Make the vehicle secure
    • Tell the police immediately if anyone is injured or there is a disagreement as to fact
    • Call Glo’ nearest office straight away
  3. If Glo ends the Agreement, it will not affect Glo’ right to receive any money it is owed under the conditions of this Agreement. Glo can also claim extra cost from Renter if Renter does not meet any of the conditions of this Agreement. Glo can repossess the vehicle and charge Renter if Glo does this.

Governing Law

This Agreement is governed by the law of the Republic of Indonesia.Any dispute may be submitted to the non-exclusive jurisdiction of the Indonesian court. If any provision of this Agreement becomes invalid or unenforceable, the remaining provisions shall not be affected.
